I agree with having it checked on BG. I am not willing to commit to my suggestion 100% either. There are more flies on that genus than I expected. :)
Thanks for the comment, ForestDragon! The reason the season is off is I'm assuming because we have a greenhouse on the front of our house that on warm days we open and let the warm air in, so... it hatched early (?). That's my guess. Thanks for the links! I agree with the genus... the species looks good to but I'm still hesitant. I will post it on the genus page on BG and see if an expert comes back with an answer. Thanks!
Beautiful little fly, a little confused about the season though. Resembles flies from Genus Dolichopus: http://bugguide.net/node/view/27118/bgpage?from=0 My guess, maybe Dolichopus comatus (strong guess, not sure): http://bugguide.net/node/view/569677
