Looks to be in the Superfamily Tephritoidea. Perhaps Family Richardiidae http://bugguide.net/node/view/89197 or Family Platystomatidae http://bugguide.net/node/view/98 (Signal Fly). Good luck with the ID Leanne!

Maybe it's some kind of ant fly (Sepsidae family)? The shape looks right but I can't find one with colouring like yours.
