Need help confirming the Merlin?

Notes:

These two sat on same branch for a few minutes the kingfisher chittering at the merlin... finally the Kingfisher took off and the Merlin flew after him but returned and sat for a long time in the sun... a lazy August day. The snag was not far behind where I sit for observations.

I am not sure this is a merlin can someone confirm?

She does indeed! Turns out it is the females that have the Rufus belt and it is a female that is torturing the Merlin... how sexist of me to assume it would be the male ;)
