I believe it is a Falcon, but I would like to know what kind and if it is for certain.

A juvenile Accipiter hawk that is either Cooper's or sharp-shinned. Judging from what seem like more forward-placed eyes and a thicker build with a lower center of gravity, I would say Cooper's but wait for others' opinions too as this identification conundrum is tricky.
