Thanks Jamie, the Gilded Flicker does look right!
I've deleted my suggestion because i just saw a picture of a female gilded flicker that looks more like this bird.
I think its a juvenile northern flicker however I am not that familiar with birds in this particular area.
That is what I thought to begin with, when it took to the side of a tree it held on in a woodpecker like way!
